Was he trying to break into Stamper's home and was only stopped when he saw her? Yes. Though he only got the screen off the window and never actually entered the home. The whole concept of breaking and entering requires that the person must be within the interior of the home, which he was not. Therefore, one cannot charge him with breaking and entering, based on the facts of the law. You Decide 12.3: J.L. claims that he was guilty of trespass rather than burglary. Do you agree? This is hard one say because yes he did trespass onto property that was not his nor did he have permission to do so.
