Jasper is a pediatrician with over 20 years of experience. He sees a 6 year-old girl climbing out of the back of the car, bleeding, and barely breathing. Jasper quickly performs CPR on the girl, but breaks seven of her ribs and she dies within minutes. The family sues Jasper because of his "rough and negligent CPR" and the child's death... Can the family win the lawsuit, and why or why not? If the family cannot win the lawsuit, does it seem fair that they have no recourse against Jasper for breaking so many of the child's ribs/her death?
